“Maker Faire Rome – The European Edition 2023”

REGULATIONS

ARTICLE 1 | Premise

1.1 | These Regulations govern the Contest entitled “MY Maker PCBA: your electronics for a better planet” (hereinafter, also the “Contest“) promoted by FAE Technology S.p.a. (hereinafter, also the “Promoter“) in collaboration with Maker Faire Rome – The European Edition, in the context of the event “Maker Faire Rome 2023” to be held in Rome from 20 to 22 October 2023, in person and digitally on the dedicated website (hereinafter, also the “Event“), with the aim of rewarding the best electronic prototyping projects (hereinafter also “Project(s)“) participating in the Event, as better described in Article 2.

ARTICLE 2 | Indication of the Contest and purpose

2.1 | FAE Technology is a company that operates in the field of embedded electronics, offering value-added services for various B2B market sectors through its assets. It operates in the field of electronic design and production, managing the complete cycle of the PCBA (Printed Circuit Board Assembly, or fully assembled electronic circuit) or of a smart device. The Contest arose from the Promoter’s desire to reward design ideas, in the prototype phase, of a particularly innovative nature, linked to the theme “MY Maker PCBA: your electronics for a better planet” (hereinafter also the “Theme“), which integrate an electronic device within them.

2.2 | The prototyping phase is the preliminary phase of an electronic project and allows the performance of a solution to be tested in the field, analysing costs and benefits, before serial production. FAE Technology, always attentive to the development of innovative projects by makers, startups, companies and creatives in general, through this Contest, intends to reward creativity and ingenuity, promoting the prototype development of electronic projects in line with the Theme of the contest. In particular, electronic projects that demonstrate that they are related to the Theme of the Contest will be awarded prizes: namely, that have as their ultimate goal the improvement of the quality of human life, for a smarter, safer, more efficient and sustainable society.

2.3 | The Prize and the special mentions will be assigned at the sole discretion of the Evaluation Committee specifically constituted by the Promoter and better described in the following Article 4 (hereinafter, the “Evaluation Committee“), during the Event.

2.4 | In order to promote the results of the Contest and to enhance the project proposals received, the Promoter may make collaboration agreements with other technical Partners interested in the Contest (hereinafter, also the “Partners” and/or “Sponsors“) that can offer support services to the project proposals received.

ARTICLE 3 | Participation in the Contest and adjudication

3.1 | Participation in the Contest is free and is addressed not only to the maker community, but to all natural persons of legal age, Italian or foreign, companies, entities, associations, foundations, and/or other legal entities, with residence or registered office in Italy and abroad (hereinafter also the “Participants” or the “Participant“), except for:

  • bodies, associations and other legal entities in which members of the Evaluation Committee, the directors in charge of the Promoter, their relatives and relatives up to the second degree as well as their cohabitants, are involved.
  • employees of the Promoter or their relatives and relatives up to the second degree or cohabitants, as well as relatives and relatives up to the second degree or cohabitants of members of the Evaluation Committee, including the President.
    It is the responsibility of the Participant to report the absence of this conflict situation through a specific self-certification, failing which the Participant shall be excluded from the Contest.

3.2 | To participate in the Contest, Participants must submit their application no later than 15 September 2023, (12.00 pm) through the appropriate link available on the Maker Faire Rome website, following the instructions and filling in all the fields required by the relative form. Participating Projects from the Event’s “Call for Makers” that fulfil the necessary requirements are entitled to participate.

3.3 | The Evaluation Committee, after having read each Project, shall subsequently proceed with the voting operations and, upon the outcome of the vote, shall announce the winning projects as described in Article 5 below. Any details relating to the announcement of the winners, date and time of the same, (including the possibility of holding a dedicated awards event in person or online) will be communicated directly to the finalists.

3.4 | Participants pre-selected as “finalists” will have to express their willingness to receive the prize, which implies full acceptance of these Regulations. To that end, they shall submit to the organisational secretariat the forms certifying the possession of the requirements and the declarations provided for by these Regulations, of which they declare as of now to know the contents and to accept them. In case of non-receipt by the Promoter of the aforementioned documentation within 3 days of the request, the award procedure cannot be completed and the Promoter itself will be free to continue in the Contest procedures, pre-selecting another Project if necessary.

ARTICLE 4 | Evaluation Committee, evaluation criteria

4.1 | The Evaluation Committee will be composed of at least 3 members identified by the Promoter, and, among these, the one who will carry out the functions of President shall be indicated.

4.2 | By 25 September 2023, the Evaluation Committee will meet and announce the names of the successful Participants insofar as they are considered most representative of the aims referred to in Article 2.

4.3 | The Evaluation Committee shall evaluate each Project and express its unquestionable opinion on the basis of the following criteria (each evaluable with a score of a minimum of 1 to a maximum of 10):

  • a) degree of innovation of the project proposal;
  • b) technical feasibility of the design proposal;
  • c) degree of development, scalability and replicability of the project proposal;
  • d) degree of efficiency and effectiveness in terms of improving environmental sustainability;

4.4 | In the event of a tie between several project proposals, the President’s vote shall prevail.

4.5 | There is no remuneration for the members of the Evaluation Committee, including the President.

ARTICLE 5 | Prize and method of disbursement.

5.1 | Following the verdict of the Evaluation Committee, the first three Projects deemed most deserving (successful bidders) shall be awarded their prizes. The award of the contest shall involve the creation by FAE Technology of a number of 1 to 10 prototypes of electronic circuit boards (developed on the basis of the Project presented, based on the level of complexity of the same for the unquestionable evaluation of the Promoter) and the possibility of presenting its Project during Maker Faire Rome – The European Edition, within the FAE Technology space, participating in the eventual award event.

5.2 | Promoters reserve the right not to award the Prize in the event that the Applications received fail to – at the sole discretion of the Evaluation Committee – attain the objectives and purposes of the Contest.

5.4 | The conferment of prizes to the creators of the selected works has the value of mere recognition of personal merit.

ARTICLE 6 | Intellectual property

6.1 | The Promoter acknowledges and guarantees that the knowledge and know-how for the conception and design of the works are the exclusive property of the creators of the Projects, who remain copyright holders. The Participants, in fact, are and will remain the owners of all intellectual property rights, property and/or image rights to their works.

6.2 | In particular, by participating in the Contest, each Participant expressly declares that their Project Proposal:

  • is original and does not violate in any way, in whole or in part, the property rights, intellectual or industrial, of third parties, hereby releasing the Promoter and the organisers of the Event from any and all responsibility, liability, claim for damages and/or compensation that may be advanced by any third party in this regard;
  • does not violate other rights of third parties, including, inter alia, patents, industrial secrets, rights deriving from contracts or licences, advertising rights or rights relating to privacy, moral rights or any other right worthy of protection.

6.3 | The Participants grant the Promoter, the organisers of the Event and the Partners of the same the right to use the Project submitted, and any other material related to it, for communication purposes, through any available means (for example: institutional Internet website, corporate intranet, social media channels), without this entailing any notice or recognition of any right to the authors of the Project, except their citation as such.

ARTICLE 7 | Miscellaneous

7.1 | These Regulations are drawn up in Italian.

7.2 | The Contest in question is not subject to the provisions of Italian Presidential Decree 430/2001 relating to the rules for competitions and prize operations pursuant to the provisions of Article 6 of the same.

7.3 | The legal conditions for applying the rules of a public auction are not met. Everything concerning the organisation of the Event, the selection of Participants, the awarding of prizes and, in general, the running of the Contest, is to be understood as confidential information of which the Promoters have exclusive ownership. Therefore, no further information shall be provided, nor may it be disclosed without the prior authorisation of the Promoters, in addition to that advertised during the Event, nor is it permitted to exhibit documents that remain for only internal purposes (therefore, by way of example, the members of the Committee and/or the Promoters shall not be required to communicate to anyone the scores obtained by the Participants during the voting, nor the ranking of the non-winning Participants).

7.4 | The Promoter reserves the right to cancel, modify or suspend, in whole or in part and at any time, the Contest, as well as all its content. In the event of cancellation of the Contest for any reason, the Promoter shall promptly notify the Contest via the “Maker Faire Rome” website. Each Participant hereby waives any right to compensation for damages – including living costs incurred for the activity carried out in the preparation of the Project Proposal and any travel and accommodation expenses, etc. – connected with the cancellation of the Contest, regardless of the causes or reasons that will have determined it.

7.5 | The Promoter reserves the right, at its sole and unquestionable discretion, to exclude from the Contest any Participant who:

  • acts in violation of these Regulations and, for participants in the Event’s Call for Makers, of the Call for Makers regulations;
  • behaves inappropriately and/or contrary to the interests of a peaceful and correct running of the Contest.

7.6 | Each Participant shall indemnify and hold harmless the Promoter, the organisers of the Event, the Partners, the Sponsors and any other third party, from any damage, prejudice, loss, cost, expense (including legal), or penalty that the same may incur as a result of the participation itself.

7.7 | The Participant, by submitting the application, authorises the Promoter, the organisers of the Event, the Partners, the Sponsors and any other third party, to publish their image as well as the photos and materials related to the Project on their websites.

7.8 | It is understood that the successful Participant, expressing their willingness to obtain the prize, fully accepts the content of these Regulations.

ARTICLE 8 | Processing of personal data

8.1 | Participants’ data for participation in the Contest and related activities (e.g., communication to winners, awarding and delivery of prizes, etc.) shall be processed by the Promoters as independent data controllers in accordance with current legislation.
This policy on the processing of personal data pursuant to Article 13 of EU Reg. 2016/679 (General Regulation on the protection of personal data, hereinafter also “GDPR“), has been developed by FAE Technology S.p.a. in its role as data controller. FAE Technology S.p.a. has appointed a Data Protection Officer who can be contacted at privacy@fae.technology

8.2 | FAE Technology shall process the data that the Participants have provided and will communicate them to the Event organisers, for activities strictly related to the running of the Contest (e.g. awarding of the prize; receipt of communications relating to the organisation and participation in the Contest). The processing of such data is based on the execution of the contract.
The personal data collected (the “Data“) shall consist in particular of:

  • personal, identification and contact data (e.g. name, surname, email address, telephone number, image);

8.3 | The personal data collected shall be processed for the time strictly necessary for the pursuit of the purposes described and in accordance with legal obligations (participation in the contest, implementation of the winning project and award of the prize). The data shall be deleted after five years from the announcement of the winner of the contest, without prejudice to any legal obligations that require further storage.

8.4 | The data collected may be processed directly by the Data Controller or by suppliers appointed as Data Processors and may be stored in computer archives or using cloud platforms with servers located in the European area.

8.5 | The data relating to the proposals submitted by the Participants (participant’s name, description and content of the project proposal, etc.) may be disclosed and disseminated on the website of the Event and/or press releases. In this case, they shall be kept without time limits.

8.6 | As a Data Subject, when the conditions are met, the Contestant may at any time exercise the rights referred to in Articles 15 et seq. of the GDPR, which include the right of access, rectification, deletion, limitation of processing, opposition, and portability.
The aforementioned rights may be exercised by sending an email to privacy@fae.technology.
If the relevant conditions are met, the data subjects also have the right to lodge a complaint with the Italian Data Protection Authority, in its capacity as supervisory authority according to the procedures in force.

8.7 | The legal basis is the performance of a contract or pre-contractual measures at the data subject’s request. The provision of Data for the pursuit of the purposes set out in this policy is optional: there is no legal obligation to provide data; however, since their processing is necessary to enable participation in the Contest, failure to communicate the data will make it impossible for the data subject to participate.

ARTICLE 9 | Applicable law and jurisdiction

9.1 | These Regulations are subject to Italian law.

9.2 | For any and all disputes concerning the interpretation or validity or execution of the same, the Court of Rome shall have exclusive jurisdiction.
